Official Rules-Back To School, Back To Style Contest (2008)
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. ELIGIBILITY: This Contest is open only to legal residents of the United States and the District of Columbia, who are 18 years of age or older at the time of entry and who reside within a 25 mile radius of one of the following cities: New York, NY; Atlanta, GA; Chicago, IL; Northern California (Bay Area and San Jose); Portland, WA; Tampa, FL; or St. Louis, MO. Employees (and their immediate families or those living in the same household) of Sponsors and Prize Providers (as identified below) and their respective affiliates, subsidiaries, divisions, parents and related companies, suppliers, printers, advertising, promotional and judging agencies are not eligible to enter or win.
2. HOW TO ENTER: Contest begins at 12:01 a.m. EDT on 4/1/08 and ends at 11:59 p.m. EDT on 5/30/08. You may enter the contest by writing in 100 words or fewer why your teacher or a teacher you know should win a $1,000 wardrobe from Jones New York and Macy's; an opportunity to participate in a fashion photo shoot with a professional photographer; classroom materials which may include books, maps and other instructional materials from Scholastic, Inc. valued at $500; and a classroom adoption by Adopt-A-Classroom (which provides teachers with an on-line account to purchase supplies for their classroom) valued at $500. Nominated teachers must be currently employed on a full time basis at a public elementary, secondary or high school in one of the geographic areas specified in Paragraph 1 above. Entrants must provide their name, address and telephone number and the name and address of the teacher that they are nominating, as well as the name and address of the school where the teacher is employed. You may enter this Contest via either the on-line or mail-in entry methods described below. Regardless of entry method, you may enter only once. Proof of depositing entry in the mail is not considered proof of delivery or receipt. Illegible, incomplete and duplicate entries will be disqualified. All entries become the property of Sponsors and will not be returned. Sponsors have the right to edit and publish all entries and photographs, as their editors deem fit. Entrants represent that entries are original and previously unpublished and do not violate any third party rights.
a. ON-LINE ENTRY METHOD: You may enter the Contest via the internet by logging on to www.jnyintheclassroom.org/backtostyle and submitting your essay on-line along with your name, address and telephone number and the name and address of the teacher that you are nominating, as well as the name and address of the school where the teacher is employed. All on-line entries must be received by 11:59 p.m. EDT on 5/30/08.
b. MAIL-IN ENTRY METHOD: Alternatively, you may mail your essay of 100 words or fewer to the following address: Jones New York In The Classroom, Back to School, Back to Style Contest, 1129 Westchester Ave., 3rd Floor Marketing, White Plains, NY 10604. You must provide your name, address and telephone number and the name and address of the teacher that you are nominating, as well as the name and address of the school where the teacher is employed. All mailed entries must be postmarked by the last day of the contest (May 30, 2008) and received no later than June 6, 2008.
3. PRIZES AND APPROXIMATE RETAIL VALUE: There will be a total of twenty-one (21) Prizes awarded. Three (3) Prizes will be awarded for each geographic area set forth in Paragraph 1. Each Prize consists solely of: (i) Jones New York Brand clothing and accessories provided by Macy's and Jones New York valued at $1,000 to be selected by Winner during a shopping trip on dates and locations to be determined by Macy's and Jones New York; and (ii) classroom materials which may include books, maps and other instructional materials from Scholastic, Inc. valued at $500; (iii) a classroom adoption from Adopt-A-Classroom valued at $500; and (iv) an opportunity for Winners to participate in a fashion photo shoot wearing their new wardrobes. The fashion shoot will consist of hair styling, make-up and a day-long photo session with a professional photographer selected by Sponsors in each of the geographic areas listed in Paragraph 1. Photographs and images from the photo session may be used in various advertising media in the future to promote "Shop For Education Week" at Macy's and other promotions. Total Approximate Retail Value of all prizes is $42,000. Failure to be available on the dates selected for the shopping trip will result in forfeiture of the wardrobe and photo shoot portions of Prize. All federal, state, and local tax liabilities are the sole responsibility of the Winners. Winners will be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification).
4. SELECTION OF WINNERS: A total of twenty-one (21) winning entries (three (3) from each geographic area specified in Paragraph 1 above) will be selected on the basis of originality, clarity and suitability of expression from among all eligible entries by judges selected by Jones New York In The Classroom, whose decisions are final and binding in all matters relating to this Contest. Prize Winners are the teachers nominated by the winning entries. The Prizes are guaranteed to be awarded. The Winners will be notified by telephone, email or mail service by 6/31/08.
5. PRIZE CONDITIONS: No substitution for any Prize will be permitted. If necessary due to unavailability of a Prize, a prize of equal or greater value will be awarded at the discretion of the Sponsors. Prize is not transferable, assignable or redeemable for cash. Winning teachers will be required to execute and return an Affidavit of Eligibility and Publicity/Liability Release within fifteen (15) days of issuance. Failure to return all required documents in this time period may result in a Winner being disqualified and an alternate Winner selected. If a prize notification is returned to Sponsors as undeliverable or if an entrant is found to be ineligible or declines acceptance of the Prize for any reason, an alternate Winner will be selected. By entering this Contest and/or accepting the Prize, Winners and entrants hereby consent (except where prohibited by law) to the reasonable use by Sponsors of the Winners' and entrants' photograph, voice, likeness and/or image, hometown address, contents of the entry form and essay submission, and the name and age of the Winners and entrants without any further compensation for any future promotional activity related to this Contest. Winners and entrants also agree and consent that all entries become the property of Sponsors and may be published and republished, in whole or in part, in all media in perpetuity without compensation
6. CONDUCT OF PARTICIPATION: By entering the Contest, entrant affirms that he or she has read and agrees to abide by the Official Contest Rules and the decisions of the judges. Sponsors reserve the right to disqualify any entrant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Contest or the website. The Contest is governed by the laws of the United States and, by entering, all Winners and entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in New York, New York. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSORS OR THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
7. LIMITATIONS OF LIABILITY: Sponsors and each of their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage due or any combination thereof. Sponsors reserve the right to modify, suspend or terminate the Contest in the event that it becomes necessary due to circumstances beyond Sponsors' control. In the event the Contest is terminated early, a winner will be selected from all eligible entries received at the time of termination.
8. RELEASE OF LIABILITY: By participating, Winners and entrants agree to release, discharge, indemnify and hold harmless Sponsors and each of their respective affiliates, subsidiaries, parent corporations, and their officers, directors, employees, representatives and agents from and against any claims made by the Winners, entrants or any other third parties related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any contest-related activity or participation in this Contest.
9.
